PRIVACY POLICY
The customer registering in the Transactional Service of the Service Provider is obliged to familiarize themselves with this Privacy Policy. The Privacy Policy constitutes an integral part of the Rules for the Provision of Electronic Services and the Rules for the Management of Internet Domains.
§1. Definitions
- Service Provider - Wojciech Guziak Chmurka.pl is a company based in Krakow (Tax Identification Number: 7722366375, National Business Registry Number: 360957383), with its registered office located at Rynek Glowny 28, 31-010 Krakow, Poland. The company specializes in selling electronic services through its website available at https://otshosting.pl.
- Customer - An individual/legal person or company registered in the Transactional Service of the Service Provider.
- Consumer - art. 221 of the Act of 23.04.1964 Civil Code (Journal of Laws from 2014, item 121 as amended). A consumer is considered to be a natural person performing a legal action not directly related to their business or professional activity.
- Regulations – the regulations for the provision of electronic services determining the rights and obligations of the Service Provider and the Customer using the electronic services offered by the Service Provider.
- Privacy Policy – a document defining the duties and rights of the Service Provider in terms of protecting the personal data of the Customer using the Service Provider's offer. It constitutes an integral part of the Regulations.
- Internet Domain Service Rules – regulations determining the rules of registration, assignment, maintenance, and transfer of domains to/from the Service Provider. It constitutes an integral part of the Regulations.
- Service Provider's Website - a website available at https://otshosting.pl, as well as the official profile of the Service Provider on social media platforms.
- Transactional Service - a distinct part of the Service Provider's Website available at https://otshosting.pl that allows managing services and making payments.
§2. General provisions
- The Service Provider informs that, based on the Act of 29.08.1997 on the protection of personal data, as part of the establishment, implementation, and termination of the contract, it will process the personal data of the Customer placing an order on the website/pages belonging to the Service Provider.
- The Customer using the services of the Service Provider consents to the processing of data.
- The Customer has the right to access their stored personal data and to modify it.
§3. Data collection
- The Service Provider will process data in accordance with §2.
- The Service Provider also informs that, when using the Service Provider's services, the Service Provider will collect data in the form of the visitor's IP address, the type of operating system, the type of internet browser.
- The Service Provider informs that on the devices through which the Service Provider's services will be displayed, information that can identify the visitor (Cookies, Session Storage, or Local Storage files) may be placed, as well as information about the number of visits to service owned by the Service Provider.
- The Service Provider, during the order process placed by the Customer, will collect such data as: first and last name and/or company name, e-mail address, contact phone number, residential address and/or company address, PESEL or NIP and REGON number.
§4. Security of stored data
- The Service Provider informs that the Customer's data during the ordering process is protected by an encrypted SSL connection meeting the generally accepted security standards.
- The Service Provider declares that it has the means and knowledge to ensure the security of the Customer's personal data. The Service Provider declares that the Customer's data will be protected against access by unauthorized persons and their complete integrity will be ensured.
§5. Data processing
- The Service Provider reserves the right to process the Customer's received data for the purpose of order fulfillment as well as for identification and settlement purposes.
- The Service Provider reserves the right to transfer the Customer's data to authorized bodies in accordance with Polish law.
- The Customer has the right to inform the Service Provider to stop processing the Customer's data. This is associated with the termination of all contracts binding the Customer with the Service Provider.
- The Service Provider may process the Customer's data despite his objection when it is necessary to settle services that the Customer uses and/or used, as well as in the event of the Service Provider pursuing claims for current and overdue payments.
- The Service Provider reserves the right to transfer the Customer's data when the Customer's action is not in accordance with Polish law and/or in the case of receiving a valid request from state authorities.
§6. Data change
- The Customer, upon request, has the right to change the personal data provided to the Service Provider.
- The Customer wishing to change personal data is obliged to deliver a request to change personal data to the Service Provider's email address: [email protected]
- The Customer is obliged to provide true data when changing personal data. In case of providing data inconsistent with reality, the Service Provider has the right to suspend the provision of services and/or to terminate the contract with the Customer.
§7. Data deletion
- The Customer has the right to delete their personal data held by the Service Provider. The Customer is obliged to deliver a request to delete personal data to the Service Provider's email address: [email protected]
- The deletion of the Customer's data is equivalent to terminating the contract with the Service Provider.
- The Service Provider reserves the right to further process data despite receiving a request to delete the Customer's personal data and/or at the time of terminating the contract with the Customer when it is necessary to settle services that the Customer uses and/or used, as well as in the event of the Service Provider pursuing claims for current and overdue payments. The Service Provider reserves the right to transfer the Customer's data when the Customer's action is not in accordance with Polish law and/or in the case of receiving a valid request from state authorities.
§8. Final provisions
- In matters not covered by the Privacy Policy, the provisions of the Civil Code shall apply.
- All controversial issues related to the Privacy Policy will be resolved by the court competent for the place of conducting business by the Service Provider, in case the Customer is not a Consumer.
- The Service Provider reserves the right to make changes to the Privacy Policy. Changes to the Privacy Policy come into force 7 days after publication on the Service Provider's Website.
